In consideration of the acceptance of my participation (and/or the participation of my child or ward) in the Celebration Games, April 13-15, 2007 (the “Event”) produced by Celebration Special Events Committee and/or any of their related, subsidiary, and affiliated companies, I AGREE TO ASSUME THE RISKS incidental to such participation and, on my own behalf, and on behalf of my heirs, executors and administrators, hereby RELEASE and forever discharge the Released Parties (defined below), of and from all liabilities, claims, actions, damages, costs or expenses of any nature arising out of or in any way connected with my participation in such activity, and further agree to indemnify and hold each of the Released Parties harmless from and against any and all such liabilities, claims, actions, damages, costs or expenses, including, but not limited to, attorneys’ and other professionals’ fees and disbursements.

The Released Parties are The Celebration Joint Committee, Inc., The Celebration Nonresidential Owners Association, Inc., The Celebration Residential Owners Association, Inc., Enterprise Community Development District, Celebration Community Development District and Lexin Celebration LLC, their respective parent, related, affiliated, and subsidiary companies and the officers, directors, employees, agents, representatives, successors, and assigns of each. I understand that this release and indemnity includes any claims based on the negligence, action or inaction of any of the above Released Parties and covers bodily injury (including death) and property damage, whether suffered by me before, during, or after such participation.

I declare that I am physically fit and that I have the required skill level necessary to participate in the Event. I further authorize the Released Parties to obtain first aid or other medical treatment for me (and/or my child or ward) at my cost, as the need arises. I/We acknowledge that the Released Parties are not responsible for supervising Minor.

I understand that the Released Parties and their respective designees have the right to photograph and make audio and video recordings of me (and/or my child or ward) at the Event and I hereby consent to the foregoing activities. I hereby represent and warrant to the Released Parties and their respective designees that I have the right to grant to the Released Parties and their respective designees, and do hereby grant to the Released Parties and their respective designees, forever, and throughout the world, the right to use my (and/or my child or ward’s) name, reproductions (audio and visual) of my (and/or my child or ward’s) physical likeness, photographs of me (and/or my child or ward) and recordings of my (and/or my child or ward’s) likeness, voice and sound during my (and/or my child or ward’s) appearance at the Event, and the right to reuse such reproductions, photographs and records of that appearance, and that name, likeness and biography of me (and/or my child or ward) as the Released Parties and their respective designees may desire, in all media, whether now known or hereafter devised, throughout the universe in perpetuity (including, without limitation, on basic cable, free and paid television systems worldwide, and all supplemental market uses, video cassette and/or video disk exploitations) and in all forms including digitalized images, without compensation to me (and/or my child or ward) or any limitation whatsoever. The Released Parties are, however, under no obligation to exercise said right.

This Agreement shall be binding upon me (and/or my child or ward) and my (and/or my child or ward’s) heirs, personal representatives and assigns and shall be governed by and construed under the laws of the State of Florida. This Agreement constitutes the entire agreement among the parties with respect to the subject matter of this Agreement and supersedes any and all previous agreements among the parties, whether written or oral with respect to such subject matter.
